05/ 18.03.2021 It has been submitted by the learned Counsel for the petitioner Mr.

D.K.Dubey that legal proposition is not in dispute. As for promotion, it is the date of

occurrence and not the date of punishment, which has to be taken into consideration.

It has been further submitted that the matter has been set at rest by the

Division Bench of this Court in case of "Sada Shiv Jha vrs. State of Jharkhand &

Ors.", 2014 (1) JLJR 451.

It has been further argued that in view of the aforesaid judgment of the

Division Bench, the State has also come with a notification of the Home Department.

However, the main issue to be decided is that in the instant case what is the date of

occurrence.

Let the respondents also file specific affidavit with the relevant records

on which they are relying as what will be the date of occurrence.

The petitioner is also at liberty to come with the relevant records to show

that what will be the date of occurrence.

Put up this case on 25.03.2021.

No further adjournment shall be granted.
