It appears that in compliance of the order dated 03.12.2018, notice issued under substituted service of notice, but till date supplementary affidavit has not been filed in this regard.

Learned counsel for the appellant, Mr. Alok Lal has submitted that no relief has been sought against the owner and driver of the offending vehicle, rather the appellant- Oriental Insurance Co. Ltd. admits that the vehicle was duly insured, as such, the instant Misc. Appeal may be heard in absence of owner and driver of the offending vehicle.

Learned counsel for the claimants/respondents, Mrs. Abha Verma has submitted that copy of memo of appeal, impugned judgment/award and other relevant documents may be provided to her so as to assist this Court properly.

Learned counsel for the appellant, Mr. Alok Lal has submitted that he will provide copy of memo of appeal, impugned judgment/award and other relevant documents upon learned counsel, Mrs. Abha Verma, a panel lawyer appointed on behalf of the claimants /respondents, by tomorrow i.e. 17.03.2021.

On the joint prayer of the parties, put up this case in the next week.

Copy of memo of appeal, impugned judgment/award and other relevant documents must be served to her by tomorrow i.e. 17.03.2021.

Office is directed to reflect the name of learned counsel, Mrs. Abha Verma, a panel lawyer appointed on behalf of the claimants /respondents in the column of respondents by deleting her name from the column of the counsel for the appellant.
