The matter was taken up through Video Conferencing. Learned counsels for the parties had no objection with it and submitted that the audio and video qualities are good.

I.A. No. 1414 of 2021.

06/ 15.03.2021 Heard learned counsel for the appellant and learned counsel for the State, on the interlocutory application, filed on behalf of the appellant for modification of the order dated 1.3.2021, passed in I.A. No. 716 of 2021.

By the said order, the appellant was granted bail, taking into consideration the fact that in the FIR as well in the evidences of the witnesses, there is only omnibus allegations against the appellant. However, this Court had noted the fact that the appellant was on bail during the pendency of trial.

It is pointed out that this appellant was not on bail, rather the other accused, having the same name but different parentage, was on bail during the trial and due to this similarity in the name, it was inadvertently mentioned that the appellant was on bail, during the pendency of trial.

The impugned Judgment, however, shows that there is only omnibus allegation against this appellant.

In view of the above, let the last sentence of 3rd paragraph of the order dated 1.3.2021, passed in I.A. No. 716 of 2021, be deleted. The other portions of the said order shall continue.

Let the certified copy of the order dated 1.3.2021, passed in I.A. No. 716 of 2021, be always issued along with this order.

The aforesaid interlocutory applications stands allowed.
