11/ 01.03.2021 Heard the parties.

Mr. A.K. Das, learned counsel appearing for the petitioner vociferously argues that petitioner has been ordered to be reinstated on the sole ground that he has been acquitted in the criminal case, which is not tenable in the eyes of law in the facts and circumstances of the case. In support of his case, learned counsel is armed with plethora of Judgments of Hon'ble Apex Court as well as of this Court.

On the other hand, Mrs. M.M. Pal, learned senior counsel appearing for the respondent-workman vehemently opposes the contention of the learned counsel for the petitioner and argues that since the petitioner has been acquitted in the criminal case, the petitioner-management cannot ignore the order of the Tribunal by not reinstating the workman.

On the request of learned counsel for the parties, list this case after two weeks i.e. on 22.03.2021, for further hearing.
