Mr. Ajit Kumar, learned Counsel for the petitioner has thrown challenge to Annexure-5 the order of rejection and submits that the same is not tenable in the eyes of law.
To buttress his argument, learned Counsel places heavy reliance on the judgment of this Court passed in W.P.(S) No.3141 of 2016 (Sahzad Alam vrs. Central Coalfields Limited & Ors.) which has been affirmed up to the Hon'ble Apex Court.
Ms. Pooja Kumari, learned Counsel for the respondents by placing heavy reliance on the order passed by the Division Bench of this Court in L.P.A.No.493 of 2017 (Central Coalfields Limited vrs. Dara Singh & Ors.) submits that compassionate appointment is not the right of the petitioner and in facts and circumstances of the present case he is not entitled for the same. Supporting the impugned order she argues that as the petitioner has crossed the age rightly the order has been passed not to entertain his claim for compassionate appointment.
Counter-affidavit has already been filed.
