05/02.07.2021 This application has been filed by the petitioner praying for initiation of a contempt proceeding against the opposite parties specifically against opposite party no.2 for non- compliance of the direction of this Court as contained in judgment/order dated 29.11.2018 passed in W.P.(C). No.4372 of 2015.

2. At the outset, learned counsel for the petitioner Mr. Ajit Kumar, submits that the opposite party no.2 has passed a speaking order pursuant to the order passed by this Court and accordingly, he does not want to press the present contempt proceedings, but he submits that he may be permitted to challenge the speaking in accordance with law.

3. Learned counsel for the State has no objection to the aforesaid prayer made by the learned counsel for the petitioner.

4. After hearing the learned counsels for the parties and considering the fact that the petitioner does not want to press the present contempt proceedings and also the fact that order passed by this court has been complied by passing a speaking

order, this Court does not choose to proceed further with the present contempt proceedings.

5. Accordingly, the present contempt proceeding is dropped.

6. However, it will be open to the petitioner to proceed in accordance with law with respect to the speaking order passed pursuant to the directions passed in the writ petition.
