05/22.01.2021 Heard Ms. Surabhi, learned counsel for the petitioner and Mr. Ashish Kumar, learned counsel for the respondent-State as well as Mr. Akash Deep, learned counsel for respondent-JMADA.
This writ petition has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic.
The respondents are directed to file counter affidavit within a period of four weeks.
Ms. Surabhi, learned counsel for the petitioner submits that the pay scale of the petitioner has been downgraded to Rs.4000-6000/- instead of Rs.5500-9000/-. This has been done without following the procedure of law. She submits that not only that it has been further directed that the said amount shall be adjusted from the amount payable to the petitioner. She further submits that the case of the petitioner is fully covered in view of the judgment of Hon'ble Supreme Court in the case of State of Punjab v. Rafiq Masih reported in (2015) 4 SCC 334.
In view of her such submission, there shall be no adjustment of amount which are required to be paid to the petitioner till the next date of listing.
Let this matter appear on 28th April, 2021 under the heading "For Admission".
