05/ 12.01.2021. Heard learned counsel for the appellant and the learned counsel for the State on the Interlocutory Application filed by the appellant for granting bail during the pendency of this appeal.
The appellant has been convicted and sentenced for the offences under Sections 18 & 29 of the Narcotics Drugs & Psychotropic Substance Act.
The impugned Judgment shows that two motorcycles were apprehended and from the pillion rider of the motorcycles, 7 Kg. Of opium was recovered. The appellant was the driver of one motorcycle.
In the facts of this case, we are not inclined to release the appellant, Fulchand Munda, on bail. Accordingly, his prayer for bail is hereby rejected.
The aforesaid Interlocutory Application stands dismissed.
