02/12.02.2021 Heard learned counsel for the parties through V.C.

2. The instant application has been preferred for extension of time to deposit the fine of Rs.25,000/- as directed by Order dated 18.01.2020 passed in Criminal Revision No. 1109 of 2014, whereby the sentence passed by the learned trial court and upheld by the learned appellate court was modified to the extent that the petitioner was sentenced to undergo for the period already undergone subject to the payment of a fine of Rs.25,000/- within a period of three months from the date of the judgment.

Mr. Praveen Shankar Dayal, learned counsel for the petitioner submits that the petitioner could come to know about the said judgment of this Court during lockdown and due to the effects of Covid Pandemic he could not deposit the fine of Rs.25,000/- within time as directed vide paragraph 18 of the aforesaid judgment.

4. Mr. Sanjay Kumar Srivastava, learned A.P.P. opposes the prayer for extension of time.

5. Having regard to the facts of the case that the petitioner was genuinely prevented due to Covid pandemic, the Criminal Revision No. 1109 of 2014 is modified to the extent that the petitioner will deposit the fine of Rs. 25,000/- within a period of six weeks from today before the learned District Legal Services Authority, Jamshedpur failing which he shall serve rest of the sentence as directed by the learned trial court.

6. With the aforesaid modification in Criminal Revision No. 1109 of 2014, the instant Cr.M.P. is disposed of.
