No one appears on behalf of the petitioner.

2. On 15.02.2021 when this criminal revision petition was listed for hearing on that day also no one had appeared for the petitioner.

3. On 15.02.2021 the following order was passed by this Court:

"On repeated calls and even after the recess no one has appeared for the petitioner.

There is no representation either on behalf of the petitioner or the learned counsel for the petitioner.

This criminal revision petition was filed on 26.09.2016 against the order dated 18.02.2016 passed in S.T No. 145 of 2012.

The petitioner is aggrieved of the order dated 18.02.2016 passed in S.T No. 145 of 2012 by which the application for release of seized cash was dismissed.

In "Asian Resurfacing of Road Agency Pvt. Ltd. and Another v. Central Bureau of Investigation", 2020 SCC OnLine SC 1046 the Hon'ble Supreme Court has passed a direction to all Court's to proceed with the matters in which any order of stay/interim order was passed but not extended further within a period of six months. In paragraph no. 2 the Hon'ble Supreme Court has observed thus:

"2........We expect that the Magistrates all over the country will follow our order in letter and spirit. Whatever stay has been granted by any court including the High Court automatically expires within a period of six months, and unless extension is granted for good reason, as per our judgment, within the next six months, the trial Court is, on the expiry of the first period of six months, to set a date for the trial and go ahead with the same."

The learned trial Judge shall proceed with the matter.

Post this matter on 09.04.2021 under the heading "Final Disposal".

Let a copy of the order be transmitted to the learned Principal District and Sessions Judge and the Court concerned through "FAX".

4. Mrs. Lily Sahay, the learned APP appears for the State.

5. Criminal Revision No. 1299 of 2016 is dismissed in default.

6. Let a copy of the order be transmitted to the Court concerned through "FAX".
