15/ 08.04.2021 Heard Mr. Niraj Shekhar, learned Counsel for the petitioner and Dr.
Ashok Kumar Singh representing the Nilamber Pitamber University.
It is specific case of the petitioner that date of absorption as decided by
Justice Agarwal Commission has been shifted by the University which is impermissible
in the eyes of law as also contrary to the ratio laid down by the Hon'ble Patna High
Court as well as this Court and also the Apex Court.
However, the same has been disputed by learned Counsel for the
University Dr. Ashok Kumar Singh that issue is somehow different and we have
considered all the judgments and thereafter we have fixed the date of absorption which is
01.06.2003 and as such there is no illegality.
Post this matter after three weeks under the same heading.
