1. The instant petition has been filed by the petitioner under Section 482
Cr.P.C./ Article 227 of the constitution of India, for exercising inherent powers
vested with this Court and setting aside the order dated 05.08.2023 passed by
learned Munsiff, Jammu in petition titled "Vidya Devi v. Lalit Sharma and Anr."
whereby the learned Trial Court has taken cognizance under Section 31 of the
PWDV Act, 2005.
2. Learned counsel for the petitioner states that, in terms of judgment passed
by this Court, the instant petition shall be treated as petition under Article 227 of
the Constitution of India.
3. After hearing learned counsel for the parties, Registry is directed to
summon the record from the Court of learned Munsiff, Jammu.
4. Await appearance of learned counsel for respondent No.3.
5. List on 11.11.2024.
