This is an application filed by the applicant seeking condonation of

delay in filing the acquittal appeal against the judgment dated 04.07.2022 passed

by the learned Principal Sessions Judge (Special Judge), Kathua.

There is delay of 41 days in filing the present appeal. For the reasons

stated in the application, the same is allowed. The delay in filing the acquittal

appeal against the judgment dated 04.07.2022 is condoned.

Application is, accordingly, disposed of.

This is an application filed by the applicant seeking leave to file the

acquittal appeal against the judgment dated 04.07.2022 passed by the learned

Principal Sessions Judge (Special Judge), Kathua.

We have gone through the judgment. The issue requires appreciation of

evidence and that can be done only if we grant leave to the applicant to file the

appeal. Accordingly, we permit the applicant to file the appeal.
