1) It is the grievance of the petitioner that though in compliance to the

judgment passed by this Court on 3rd February, 2016, in SWP

No.2940/2001, consideration order was passed by the respondents bearing

No.14-KICC of 2019 dated 28th of July, 2019, whereby and where-under

the petitioner was granted the benefit of promotion as Computer

Programmer with effect from 28th of February, 2013, with all

consequential benefits. However, the aforesaid order has only remained

on paper and the petitioner has neither been given the promotion to the

post of Computer Programmer by posting him against the said post nor

the consequential benefits accruing to the petitioners have been released.

2) Learned counsel for the petitioner submits that time and again the

respondents have been seeking adjournments to do the needful.

3) Mr. Natnoo, learned counsel appearing for the respondents, seeks a

further opportunity to find out as to why the order passed in favour of the

petitioner has not been given effect to. He is given four weeks last and

final opportunity to file an affidavit as to why the order dated 28th of July,

2019 has not been given effect to in letter and spirit. The concerned

official shall also explain reasons for such lapse.

4) It is made clear that in case the order of consideration dated 28th of

July, 2019, passed by the respondents is not given effect to in letter and

spirit by or before next date, Director, SKICC, shall appear in person on

the next date.

5) List the main petition on 23rd of July, 2021.
