Heard Shri. Z. A. Qureshi, learned Senior counsel appearing for the

appellant and Shri Irfan Andleeb, learned Deputy Advocate General,

appearing for the respondents.

The appellant has challenged the judgment and order dated

27.11.2019 passed by Writ Court whereby the writ petition of the appellant

has been dismissed stating that no relief can be granted to the petitioner

inasmuch as the contract has been assigned to the third party and has been

completed.

A perusal of the documents reveal that the appeal has lost all its

efficacy with the afflux of time inasmuch as the contract was awarded in

the year 1999 and has been completed in the year 2001, therefore, the

appellant is not entitled to any contract at this juncture.

Learned counsel for the appellant submits that the judgment and order

passed in the OWP no. 663/1999 which is the subject matter of this appeal

may not affect his rights in his other writ petition i.e. OWP 155/2000

wherein the appellant has challenged the allotment of contract in favour of

the third party.

The said writ petition is independent one and, therefore, this appeal is

dismissed with the observation that the aforesaid writ petition would be

decided on its own merits uninfluenced by any finding or observations

recorded here in this appeal or in the judgment and order impugned in this

appeal.

The record of OWP no. 155/2000 is directed to be returned, to be listed before the appropriate Bench.
