The appeal is beyond time by 213 days. In the delay condonation application it has been stated that the judgment was pronounced on 02.07.2019 and that the department accorded sanction for filing of appeal vide letter dated 02.02.2021. However, the explanation falls short of stating as to what the authorities were doing between July, 2019 till the start of the first wave of COVID-19 pandemic i.e., March 2021 and as to why they could not grant sanction during the said period or file the appeal immediately.

In view of the above, in the interest of justice, we allow learned counsel for the appellant to file a better affidavit explaining the aforesaid delay.
