Heard learned counsel for the parties.
There is a delay of 22 days in filing the appeal. The judgment and order impugned is dated 17.5.2021, which was passed during the second wave of the Covid19 pandemic. Therefore, in view of the orders of the Supreme Court in writ petition (civil) No. 3/2020 "Re: Cognizance for Extension of Limitation" dated 23.3.2020, the limitation stands extended, and as such we are of the view that there is hardly any delay and the delay, if any, has been sufficiently explained. Accordingly, we condone the delay in filing the appeal.
The delay condonation application CM (5433/2021) is allowed. Registry to list the appeal for admission on 2.9.2021.
