This application has been moved by the

applicant/respondent for release of the amount awarded in

his favour in terms of the judgment assailed by the

appellants/non-applicants. The main appeal has been

dismissed vide judgment dated 05.07.2022.

The learned counsel for the non-

applicants/appellants submits that he has no instructions

as to whether judgment dated 05.07.2022 has been further

assailed before the Hon'ble Apex Court. The learned counsel

for the applicant/respondent submits that the applicant has

not received any notice of any appeal etc. in connection with

assailing of judgment dated 05.07.2022, passed in RSA No.

110/2009.

A period of more than three months has passed

since pronouncement of the judgment. No reply to the

application has been filed. In the aforesaid circumstances, the

application is allowed. The amount deposited by the

non-applicants/appellants is ordered to be released in favour

of the applicant, alongwith up-to-date interest, in terms of

judgment dated 05.07.2022, passed in RSA No. 110/2009,

read with judgment and decree dated 29.09.2008, passed by

the learned Additional District Judge, Solan, District

Solan, H.P., in Appeal No. 12-S/13 of 2008. The amount be
