Admitted on following substantial questions of law:

1. Whether the Learned Commissioner misread, mis- appreciated and misconstrued the provisions of law, pleadings and evidence adduced on record, as a result of which, findings came to be vitiated?

2. Whether the deceased Jeevan Singh was under the

employment of respondent No.4 or not?

3. Whether the Insurance Company is liable to pay interest on the award amount under Employees' Compensation Act?

Post admission notices be issued returnable within six

weeks, on taking steps within one week. Records of the case be

called for.

CMP No. 6205 of 2021

Since entire sum of Rs. 8,70,323 as awarded by the

court below stands deposited in the court below as is evident from

receipt (Annexure A-1), prayer made in the instant application

deserves to be allowed. Consequently, the application is allowed

and operation of the impugned judgment dated 5.1.2021, passed

by the learned Commissioner Employee's Compensation Act,

Rampur Bushahr, District Shimla, H.P. in CIS Reg No.9/2015, CIS File No.

244/2015 shall remain stayed. Application stands disposed of.
