The present appeal is preferred by the State against

judgment and order of acquittal dated 30.03.2010 passed by the

Additional Sessions Judge (FTC-3), Bhavnagar at Mahuva in

Sessions Case No.141 of 2003. By the said judgment and order,

the respondent herein came to be acquitted for offence under

Section 302 of the Indian Penal Code.

Today, when the matter is taken up for hearing, learned

APP has reported that the sole respondent-accused has expired on

26.04.2022. Learned APP produced on record his death certificate.

In view of the aforesaid, the appeal stands abated.
