                              ORAL ORDER

1. Present petition is filed by the petitioner challenging the

judgment and order dated 13.12. 2022 passed by the learned

2nd Additional District Judge, Mehsana at Visnagar in Civil

Misc. Application No.8 of 2017 in which, the learned

Additional District Judge has confirmed the order dated

18.01.2017 pased below Exh.5 by the learned Additional

Senior Civil Judge, Visnagar in Regular Civil Suit No.50 of

2012.

2. After arguing the matter for some time, Mr. Archit Jani,

C/SCA/2694/2023 ORDER DATED: 20/03/2023

learned advocate appearing for the petitioner does not press

this petition and seeks permission to withdraw the same. He

also prays that the suit can be expedited, which is pending

before the learned trial court.

3. In view of above, permission as prayed for is granted.

The petition stands disposed of as withdrawn. It is also

directed that the Regular Civil Suit No.50 of 2012 pending

before the court of learned Additional Senior Civil Judge,

Visnagar shall be proceeded in accordance with law and shall

be decided/ disposed of within six months from today. It is

expected from both the parties to cooperate in the

proceedings of the suit. It is always open for the parties to

approach this Court in case of difficulty. Notice discharged.
