At the outset, learned advocates appearing for the respective parties have submitted that the issue raised in the present first appeal will be governed by the judgment and order passed in First Appeal No.2608 of 2020 and this connected first appeal has already been decided by this Court.

Accordingly, the present first appeal is disposed of in terms of the First Appeal No.2608 of 2020 since the same arises from the very same judgment and award passed by the reference court. As a sequel, civil application does not survive and the same is disposed of accordingly. R & P be sent back to the concerned court below.
