Mr. Shaival M. Patel learned advocate states that he has received instructions to appear for and on behalf of the respondent no.2 and sought permission to appear on behalf of the respondent no.2. Permission; as sought for; stands granted. He shall file his Vakalatnama before the Registry. Registry shall accept the same.

By this application under section 5 of the Limitation Act, 1963, the applicant seeks condonation of delay caused in filing the Criminal Revision Application No. 1084 of 2022 against the judgment and order dated 03.03.2020 passed by learned City Civil and Sessions Judge, City Civil and Sessions Court,

R/CR.MA/18332/2022 ORDER DATED: 20/10/2022

Court No. 8, below Ex. 27 in Special POCSO Case No. 61 of 2017.

Having regard to the submissions advanced by the learned advocate for the applicant as well as objections raised by learned advocate for the respondent no.2 and more particularly considering the averments made in the memorandum of application, the Court is of the view that the delay caused in filing the Criminal Revision Application No. 1084 of 2022 has been sufficiently explained.

The application, therefore, succeeds and is accordingly, allowed. The delay caused in filing the Criminal Revision Application No. 1084 of 2022 is hereby condoned.

Present Application stands disposed of. Rule is made absolute.
