ORAL ORDER
This is an application for leave to appeal filed under Section 378(4) of the Cr.P.C. challenging the judgment and order dated 17th August, 2020 passed by the 6th Addl. Chief Judicial Magistrate, Surat in Criminal Case no.11351 of 2016, wherein the learned Magistrate was pleased to acquit the respondent accused from the offence punishable under Section 138 of the Negotiable Instruments Act.
Heard Mr. Atit Thakore, learned advocate for the applicant and Ms. Mona Gupta, learned advocate appearing on behalf of Mr. Gandhi, learned advocate for the respondent nos.2 to 7.
Ms. Gupta, learned advocate has objected the granting of leave to appeal application and has prayed to reject the same.

Considering the facts and circumstances of the case, I am of the opinion that the present application requires consideration and hence, the same is allowed. Leave as prayed for is granted. Rule made absolute.
