Heard Mr. Samir B. Gohil, learned advocate for the applicants. Mr. Kunjal D. Pandya, learned advocate for the respondent No.2 is absent. Respondent No.1 has refused to accept the service of notice of rule.

This is an application under Section 5 of Limitation Act to condone the delay of 31 days which has occurred in preferring an appeal to challenge the impugned judgment and order of the City Civil Court, Ahmedabad.

For the reasons stated in the application, the present application is allowed. The delay which has occurred in preferring an appeal is condoned.

Present application stands disposed of.
