Mr. Premal S. Rachh, learned advocate for the petitioners, produces on record a copy of judgment and order passed by the Additional District Judge, Visavadar, dated 08.03.2019, whereby an application praying for condonation of delay in preferring Regular Appeal came to be rejected. He has further submitted that the present petition arises out of execution proceedings pursuant to a judgment and decree passed by the trial Court, which was challenged as aforesaid and the said challenge has failed, and therefore, present petition has become infructuous.

Mr. Premal S. Rachh, learned advocate for the petitioners, on instructions, seeks permission to withdraw this petition. Permission as prayed for is granted. This petition stands disposed of as withdrawn.
