Rule returnable forthwith. Mr. Sudhir M. Mehta, learned advocate waives service of notice of rule on behalf of the respondent No.1 and Mr. Soaham Joshi, learned AGP waives service of notice of rule on behalf of the respondent No.2.

The applicant has preferred present application under Section 5 of the Limitation Act to condone the delay which has occurred in preferring Cross-objection in First Appeal which has preferred by the respondent No.1 to assail the impugned judgment and award of the Reference Court.

Considering the averments made in this application, the delay is condoned. The application stands disposed of. Rule is made absolute.
