Heard Ms. Urmila N. Desai, learned AGP for the applicant and Mr. K.M. Sheth, learned advocate for the respondent.

This is an application under Section 5 of Limitation Act to condone the delay which has occurred in preferring an appeal to assail the judgment and award of the reference Court.

Having considered the submissions of learned advocates and having considered the averments made in para-3 of the application, I am of the view that the delay is sufficiently and satisfactorily explained.

Considering the averments made in this application, the delay is condoned. The application stands disposed of.
