                                  ORAL ORDER

1. Mr. RD Dave, learned Advocate submitted that the present civil application has been filed seeking condonation of delay of 1040 days occurred in preferring the captioned the appeal which has been filed against the judgment and order dated 27.01.2017 in Land Acquisition Reference No. 74 of 1992. It is submitted that all the steps were taken so as to ensure that the claimants are served, including substitute service. It is submitted that on 17.10.2022, the Court also granted last chance to enter appearance, if they so desire, however, till date no steps have been taken.

2. Having regard to the averments made in the application so also the oral submissions, this Court is of the opinion that the present Civil application deserves to be allowed.

3. Accordingly, civil application stands allowed in terms of paragraph no. 1(A). The delay of 1040 days occurred in filing the appeal is hereby condoned.

4. Rule is made absolute to the aforesaid extent. No order as to costs.
