1 We have heard Mr. Antani, the learned A.G.P. appearing for the appellants and Mr. Nikunt Raval, the learned counsel appearing for the claimant.

2 Pursuant to the order passed by this Court dated 2nd August 2021, the entire amount towards the award with proportionate cost and interest has been deposited with the Land Reference Court.

3 This is an application at the instance of original opponents seeking stay of the judgment and award passed by the Principal Senior Civil Judge, Borsad at Anand dated 4th September 2019 in the Land Acquisition Reference Nos.167, 169, 170, 172 to 174, 176, 178, 180, 403, 404, 508, 509 and 513 2017.

4 Considering the facts of the case, the Trial Court shall invest 50% of the awarded amount in a cumulative Fixed Deposit Receipts in a Nationalized Bank initially for a period of 03 years and renewable from time to time for similar period till the final disposal of the appeal and 50% of the awarded amount shall be disbursed in favour of the original claimant upon proper verification within a period of eight weeks. The original Fixed Deposit Receipts to be retained by the Trial Court. The Civil Application stands disposed of accordingly.
