                   ORAL ORDER

1. Rule. Learned Additional Public Prosecutor waives service of notice of Rule for the respondents.

2. This petition is filed by the petitioner with a prayer to release him on parole leave for a period of 45 days in order to file an appeal before this Court against the judgment and order of conviction dated 18.06.2021 passed by the concerned Sessions Court.

3. Heard Ms.Tanaveer K. Loladia, learned advocate for the applicant and Mr.Chintan Dave, learned Additional Public Prosecutor for the respondents.

4. I have perused the averments made in the application. I have also perused the Jail remarks. Considering the reason stated in the application and considering the facts and circumstances of the present case, I am inclined to consider the case of the petitioner.

5. The petition is, therefore, partly-allowed. The petitioner shall be released on parole leave for a period of 15 days from the date of his actual release, on executing personal bond of Rs.5,000/- (Rupees five thousands) before the Jail authority and on usual terms and conditions. The petitioner shall surrender before the Jail authority on expiry of the parole leave, without fail. The Jail authority shall adhere to its own circular relating to Covid-19. Rule is made absolute in the above terms.
