Learned advocate Mr. Chudasama has submitted that the issue is squarely covered by various judgments of this Court. He has placed reliance on the judgment dated 16.10.2019 passed in Special Civil Application No. 20873 of 2015, which is confirmed by the Division Bench of this Court vide order dated 28.1.2021 passed in Letters Patent Appeal No. 632 of 2020.
