Heard learned advocate for the applicant. The

respondent No.3 seems to be the owner of one of the

offending vehicles is not served. However, for the

purpose of disposal of the present application, his

presence is not required.

Present application is preferred for condonation of

delay which has occurred in preferring appeal to

challenge the impugned judgment and award passed by

the Tribunal.

Considering the averments made in the application

and the facts of the case, delay is hereby condoned. The
