1. By this Civil Application, the applicants - original writ petitioners have prayed for the following reliefs:

"(a) This Hon. Court may be pleased to further direct the Respondents to grant refund of the amount of IGST already paid by the Applicants pursuant to the impugned Entry No.10 of Notification No.10/2017-IGST (Rate) dated 28.06.2017 with appropriate interest on such refund.

(b) Such other order as deemed fit in the facts and circumstances of the case may kindly be passed in the interest of justice for which act of kindness your applicants shall forever pray."

2. We have heard Mr. Uchit Sheth, the learned counsel appearing for the applicants and Mr. Priyank Lodha, the learned Standing Counsel appearing for the opponents.

3. We are informed that the judgment and order passed by

C/SCA/10480/2019 IA ORDER DATED: 07/09/2021

this Court dated 23.01.2020 in the Special Civil Application No.726 of 2018 and allied writ petitions is now a subject matter of challenge before the Supreme Court. We are further informed that the Supreme Court is to start with the final hearing of the appeal tentatively from 14.09.2021.

4. In such circumstances, we are of the view that we should wait for some time so as to see the outcome of the challenge before the Supreme Court.

5. Post this application on 26.10.2021.
