For the reasons recorded in the judgment, the appeal succeeds and is allowed. The impugned judgment and order of conviction dated 7.2.2013 passed by learned 2nd Additional Sessions Judge, Bhuj @ Kutch in Sessions Case No.77 of 2011 by which the appellant has been convicted for the offence punishable under Section 302 of the Indian Penal Code and ordered the appellant to undergo life imprisonment with a fine of Rs.1,000/- and in default of payment of fine, ordered to undergo further simple imprisonment of one month is quashed and set aside. The appellant be set at liberty forthwith, if not required in any other case.
