(PER : HONOURABLE THE ACTING CHIEF JUSTICE MR. JUSTICE R.M.CHHAYA) By this application under Section 378(1)(3) of the Code of Criminal Procedure, 1973, the applicant-State has prayed for leave to file an appeal against the judgment and order of acquittal dated 16.09.2020 passed by the learned Principal District and Sessions Judge, Gir Somnath in Sessions Case no.29 of 2015.

In facts of this case, leave as prayed for deserves to be granted and is hereby granted. Accordingly, the present application is allowed.

The appeal be listed for its admission. Registry is directed to call for the Record and Proceedings of the case from the concerned Court.
