Order in Criminal Misc. Application No. 19669 of 2021

1. Rule.

2. The present Criminal Miscellaneous Application is filed by the applicant- State under Section 378(1)(3) of the Code of Criminal Procedure seeking leave to appeal challenging the impugned judgment and order dated 27.1.2020 passed in Sessions Case No. 77 of 2019 by the 4th Additional Sessions Judge, Panchmahal at Halol recording the acquittal under the Gujarat Animal Preservation Act.

3. Heard learned APP Ms. Monali Bhatt for the applicant - State.

4. Perused the judgment and order dated 27.1.2020 passed in

R/CR.MA/19669/2021 ORDER DATED: 16/11/2021

Sessions Case No. 77 of 2019 by the learned 4 th Additional Sessions Judge, Panchmahal at Halol and considering the averments made in the application and considering the submissions made by the learned advocate for the appellant, the matter requires consideration. Therefore, the leave to appeal as prayed for deserves to be granted and the present Criminal Misc. Application stands allowed and disposed of accordingly. Rule is made absolute.

Issue bailable warrant in sum of Rs.5000/- against he respondent - accused.
