                                 ORAL ORDER

1. RULE. Learned APP waives service of Rule on behalf of the respondent­

State.

2. This is petitions for parole leave by the convicts. The convicts are

convicted by the District Court, Bharuch and are ordered to undergo life

imprisonment in Sessions Case No.44 of 2008 by judgment and order dated

18.03.2009 and in Sessions Case No.13 of 2008 by judgment and order dated

20.10.2008.

3. Learned Advocate for the petitioners submitted that the petitioners

seeking parole leave on the ground of mother of the under trial prisoners has

expired and presence of the petitioners is required for the various after death

rituals. A copy of the Death certificate is annexed with this application..

4. Learned APP submitted from the jail report that earlier when the

petitioners were released on parole leave in the month of November, 2020,

they have reported in time. The jail conduct are also reported to be good.

5. In that view of the matter, the petitions are partly allowed. The

petitioners are ordered to be enlarged on parole leave for a period of

7 (Seven) days from the date of their actual release on usual terms and

conditions, including furnishing a bail bond of Rs. 5,000/­ each to the

satisfaction of the jail authority. The petitioners shall surrender before the jail

authority on or before the expiry of the parole leave. Rule is made absolute.

Direct service is permitted.
