Heard learned Advocate Shri Rathin P. Raval for the applicant, learned Advocate Shri Hiren Modi for the respondent Nos.1 to 4 and learned Mrs. Vasavdatta Bhatt for the respondent No.5.

By way of this application, the applicant prays for fixing First appeal No.2878 of 2018 with Civil Application No.2 of 2018 for final hearing on an early date.

Learned Advocate Shri Raval draws attention of this Court to the execution warrant issued by the learned 3rd Additional District Judge, Dahod in so far as the impugned judgment and award is concerned. Considering the same, learned Advocate submits that the First Appeal as

well as accompanying Civil Application is required to be fixed for hearing on an early date.

Learned Advocate Mrs. Bhatt and learned Advocate Shri Modi do not have any objection for fixing the First Appeal and Civil Application.

In view of the above, Registry is directed to list the First Appeal No. 2878 of 2018 with Civil Application No.2 of 2018 for final hearing on 18.03.2021. This application is accordingly disposed of.
