This matter has been taken up upon a mention being made by Mr. Vaibhav Vyas, learned counsel for the applicant, who is a retired officer and is not being paid pension.

Mr. Dharmesh M. Devnani, learned Assistant Government Pleader, upon instructions received from the Joint Director (Legal) dated 29.01.2021 has forwarded the same along with other documents to show that the department is seriously following up the matter as they have lost right up to the Supreme Court. The data of all the similarly placed applicants covered by the judgments of this

court is being collected and a proposal has already been sent to the government indicating the financial aspects. He further submitted that if some time is allowed to the opponent, actual compliance would be effected.

Before granting time to Mr. Devnani, it would be pertinent to mention that in contempt matters once notice is issued and it is served upon the opposite parties, no communication of compliance, either oral or written should be put up before the Court except and only by way of affidavit of the opposite parties and not of their subordinate officers. Shri Devnani prays for and is granted four weeks time to file affidavit of actual compliance.
