What is prayed in this Civil Application by the original claimant is to vacate the stay granted by this court.
It transpires from the order in Civil Application No. 1 of 2019 in the main First Appeal that this court granted stay against the impugned judgment and award passed by the Motor Accident Claims Tribunal on condition that the awarded amount is deposited by the appellant insurance company. It was stated undisputedly that the amount is deposited.
In view of the above, the captioned Civil Application containing prayer for vacation of interim relief is misconceived and is liable to be dismissed. Accordingly, it is dismissed.
