 CORAM: HONOURABLE MR. JUSTICE S.H.VORA

                           Date : 06/04/2021

                             ORAL ORDER

By way of present revision application, the petitioner has made following prayer, paragraph 7(A) reads thus:

"(A) That this Hon'ble Court may be pleased to admit and allow

this Revision Application and call for Record and Proceedings of Cr.

Misc. Application No.69 of 2019 in Criminal Appeal from the Court

of the Sessions Judge, Junagadh, and after perusing the same be

pleased to quash and set aside the impugned judgment and oder

dated 11.02.2020 passed by the Ld. Sessions Judge, Junagadh in

Cr. Misc. Application 69 of 2019 in Criminal Appeal condoning the

delay of 91 days and allowing the Criminal Appeal filed by respondent No.2."

2. Having heard learned Advocates appearing for the respective parties, it appears that the learned Sessions Court has condoned the delay of 91 caused in preferring the Criminal Appeal filed against the judgment and order dated 24/09/2018 passed in Criminal Case No.793 of 2009. The learned Sessions Judge after considering the grounds caused in preferring the delay application and considering

R/CR.RA/433/2020 ORDER

the submissions made at bar condoned the delay of 91 days, for which this Court does not find any illegality or impropriety in the impugned order which calls for interference at the hands of this Court. Accordingly, present revision application is rejected. Rule is discharged.
