1. Heard Ms. A. Gogoi, the learned counsel for the applicants.
2. This application under Section 5 of the Limitation Act, 1963 has been filed by the applicants praying for condoning the delay of 851 days in Page No.# 3/3
preferring the connected MAC appeal, whereby the judgment and award dated 24.02.2023, passed in MACT Case No. 58/2017 by the learned Member, Motor Accident Claims Tribunal, Lakhimpur, North Lakhimpur has been impugned.
3. Issue notice to the respondents.
4. The applicant shall take steps for issuance of notice upon the respondents by speed post as well as by usual mode within 7(seven) days from the date of this order, returnable after 4(four) weeks.
5. The learned counsel for the applicants submits that a minor typographical mistake has been crept in the last line of Page 5 of the instant condonation delay application in as much as in place of word 'earner' the word 'winner' has been mentioned and in place of the word 'accident' the word 'death' has been mentioned.
6. The applicant is allowed to rectify the said defect and submit a corrected page-5 of the petition before the next date fixed.
7. List accordingly.
