Heard Ms. M. Saikia, learned counsel for the applicant/appellant.
This is an application filed under Section 5 of the Limitation Act, 1963 praying for condonation of delay of 82 days in filing the connected appeal against the judgment and award dated 06.01.2025, passed by the learned Member, MACT No.1, Kamrup (M), Guwahati in MAC Case No. 249/2018.
Issue notice to the respondents.
The applicant/appellant shall take steps for service of notice on the respondents through usual process.
Further, Ms. Saikia, learned counsel submitted that the respondent Nos. 3 and 4, Page No.# 3/3
owner and driver respectively of the case are not necessary parties and accordingly, she prayed that the names of respondent Nos. 3 and 4 may be struck off from the cause title of this petition.
Considering the submissions of Ms. Saikia, learned counsel, the name of respondent Nos. 3 and 4 be struck off from the cause title of this case at the risk of the applicant/appellant.
Registry shall do the needful.
