02.05.2025 Heard Shri J Firdaus, learned counsel appearing on instructions of Shri M Saikia, learned counsel for the petitioners. Also heard Shri S Dutta, learned Standing Counsel, P&RD Department, Assam.

The learned counsel for the petitioners has informed that the petitioner no. 2 has passed away in the meantime and therefore, he would be pressing this petition only for the petitioner no. 1.

The claim is for regularization of service which is based on the length of service rendered.

Shri Dutta, learned Standing Counsel, however, submits that the petitioners were having the benefits of the judgment passed in the case of State of Assam Vs. Upen Das, reported (2017) 4 GLR 493 and prays for 3 weeks' time to file the affidavit-in- opposition.

However, considering that the writ petition is of the year 2021 and sufficient time has elapsed, the prayer for grant of 3 weeks' time to file the affidavit-in-opposition is not acceded to.

However, in the interest of justice, a slight accommodation is granted to enable the learned Standing Counsel to obtain the instructions.
