25.06.2025 Heard Ms. S.B. Choudhury, learned counsel for the petitioner. Also heard Ms. S. Konwar, learned Government Advocate, Assam for the respondent Nos.1, 2, 3 and 6 and Ms. S. Chutia, learned Standing Counsel, Elementary Education Department for the respondent Nos.4 and 5.
(2) Having regard to the nature of the case as projected by the petitioner, this writ petition is taken up for disposal at the motion stage itself.
(3) This is the second time the petitioner is before this Court. Petitioner's first writ petition, being, WP(C) 5333/2023 was disposed of by this Court vide order dated 18.09.2023 by directing the respondent authorities concerned to place the case of the petitioner for compassionate appointment before the District Level Committee (DLC) of Karimganj district. Subsequent thereto, the case of the petitioner was placed before the DLC meeting held on 30.11.2023. In the minutes of the said meeting, the petitioner's name was reflected at Sl.No.8 wherein it was stated that the DLC had decided to recommend the petitioner for appointment on compassionate ground. However, despite the said recommendation, since the petitioner's case has not been considered by the State Level Committee (SLC), the petitioner is again before this Court.
(4) Ms. S.B. Choudhury, learned counsel for the petitioner submits that similar writ petitions have been disposed of by this Court by directing the cases of the petitioners in those writ petitions to be placed before the DLC or SLC concerned. In this connection, learned counsel for the petitioner has referred to the order of Page No.# 3/3
a Coordinate Bench of this Court dated 04.06.2025 passed in WP(C) 2888/2025 wherein reliance has been placed upon the earlier judgment of this Court dated 03.04.2025 passed in WP(C) 342/2025. Learned counsel for the petitioner, therefore, submits that the instant writ petition may be disposed of in the similar manner.
(5) Ms. S. Chutia, learned Standing Counsel, Elementary Education Department submits that as per the instruction received by her, case of the petitioner has been forwarded to the SLC by the Secretary to the Government of Assam, Department of School Education (Elementary) vide order dated 17.02.2024. Therefore, it appears that the matter is pending for consideration of the SLC.
(6) In view of the above, this writ petition is disposed of by directing the respondents to consider the case of the petitioner in terms of the recommendation made by the DLC, Karimganj on 30.11.2023. The respondent No.4, the Secretary to the Government of Assam, Department of School Education (Elementary) shall ensure that the case of the petitioner is placed before the next sitting of the SLC for consideration, as directed hereinabove.
With the above observation and direction, this writ petition stands disposed of.
