Heard Mr. L R Mazumder, learned counsel for the petitioner. The is an application filed under Section 438 and 442 of the BNSS, 2023 assailing a judgment and order dated 23.10.2024 passed by the learned Additional Sessions Judge, Bilasipara in Criminal Appeal case No. 05.2022 upholding and affirming the judgment and order dated 04.08.2022 passed by the learned SDJM (M), Bilasipara in CR case No. 757/2018.

Issue notice, returnable after four weeks.

Mr. P Barthakur, learned Additional Public Prosecutor, Assam accepts notice on behalf of respondent No. 1. Petitioner to take steps for service of notice upon the respondent No. 2 both by registered post with A/D and usual process within a period of one week from today.

Considering the submission of the learned counsel for the petitioner, it is provided that the judgment and order dated 23.10.2024 passed by the learned Additional Sessions Judge, Bilasipara in Criminal Appeal case No. 05.2022 upholding and affirming the judgment and order dated 04.08.2022 passed by the learned SDJM (M), Bilasipara in CR case No. 757/2018 shall remain suspended till the returnable date subject to the condition that the petitioner shall deposit an amount of Rs. 1,00,000/- before the Registry of this court within a period of four weeks from today.
