Heard Mr. V.K. Barooah, learned counsel for the appellant. Also heard Mr. B. Sarma, learned Additional Public Prosecutor, Assam appearing for the State respondent.

This is an application u/s.430 of the BNSS, 2023, praying for suspension of sentence passed against the present appellant/applicant in the judgment and order dated 19.03.2024, passed by the learned Assistant Session Judge No.1, Cachar at Silchar in Sessions Case No.47/2021, convicting the accused appellant under Section 376 of the IPC and sentenced him to undergo R.I. for 8 (eight) Page No.# 3/3

years with default stipulation.

Let the matter be listed along with the connected Crl. Appeal No.385/2025 after four weeks, enabling the State respondent to file their written objection, if any.
