This is an application under Order 41 Rule 5 of the C.P.C praying for stay Page No.# 3/3
of the operation of the impugned judgment and award dated 24.03.2025 passed by the Ld. Member, M.A.C.T, Nagaon, Assam in M.A.C Case No. 230/2022.
Mr. R Goswami, learned counsel for the appellant has submitted that there are two grounds in the appeal which are valid grounds and the award is therefore, required to be stayed. Upon going though the grounds of appeal taken in the appeal memo, this Court is of the view that the judgment and award can be stayed, at this stage, pending the disposal of the appeal.
In view of the above, the impugned judgment and award dated 24.03.2025 passed by the Ld. Member, M.A.C.T, Nagaon, Assam in M.A.C Case No. 230/2022 is stayed subject to deposit of 50% of the total awarded amount before the Registry of this Court within a period of 60 (sixty) days.
In the event of the amount being deposited, the same may be released to the claimants after proper identification and verification.
Out of the deposited amount, Rs. 4,00,000/- may be released to the respondent No. 4 Ms. Dimbeshwari Borah and the rest to the claimant No. 1.
In view of the above observations, this Interlocutory Application stands disposed of.
