Sarma, learned Additional Public Prosecutor appearing for the State respondent No.1 and Mr. G. Baishya, learned counsel appearing for respondent No.2.

This is an application under Section 430 of BNSS against the impugned judgment and order dated 15.06.2024 passed by the learned court of the Additional Sessions Judge No.1, Kamrup(M), Guwahati in Criminal Appeal No. 07/2017 affirming the judgment of the Chief Judicial Magistrate, Kamrup(M), Guwahati in G.R. Case No. 1651/2005 whereby the petitioner was convicted under Sections 420/468/471/34 IPC and sentenced to undergo RI for two years with fine.

It is submitted by learned counsel for the applicant that the applicant was convicted under Section 420/468/471/34 IPC and sentenced to undergo RI for two years on each count with fine. It is further submitted that the applicant was on bail during trial and appeal, so he may be allowed to go on bail.

On the other hand Mr. B. Sarma, learned Additional Public Prosecutor and Mr. Baishya, leaned counsel appearing for respondent No.2 has made no objection on the prayer of the petitioner.

In view of above, the petitioner is allowed to go on bail of Rs.30,000/- with one suitable surety of like amount to the satisfaction of learned Chief Judicial Magistrate, Kamrup(M).

Accordingly, the interlocutory application stands disposed of.
